Terms and Conditions

The terms and conditions of Whitehaven Watches are related to your purchases from the website www.whitehavenwatches.com and include the use of the website. They are a contract between Whitehaven Watches and yourself. England company registration number GB922828906, 124 Cromwell Road London, SW7 4ET United Kingdom. When making a purchase from Whitehaven Watches and using the website, you form an agreement with the Terms and Conditions.

Confirmation of Order

Following receipt of your order, you will be sent an electronic invoice to your email address which serves as confirmation of your purchase. The confirmation of purchase is also your proof of purchase guarantee.

Payment

Purchases can be made using a credit or debit card. Whitehaven Watches does not store credit card details.

Payment by Card

Whitehaven Watches can be paid for using your AMEX, Mastercard or Visa Card online. All payments are secure and use encryption under banking standards. Card details are sent to your bank and cannot be seen by anyone other than your bank. We do not charge extra for card payments. Once card transaction is approved, your order is live, if no payment is received following placement of order, Whitehaven Watches reserves the right to cancel your order.

Promotional Codes

If you have a promotional code, it should be entered during checkout for validity. You are unable to add it following purchase.

Tax

All prices on the Whitehaven Watch website include VAT. For orders shipped outside of the EU, VAT is removed at checkout (or earlier depending on where the item is shipped to). Reference orders to be delivered outside of the EU may be subject to import duties and taxes. These are usually collected once shipment arrives at the destination address and you are wholly responsible for payment of any tax or duties. Whitehaven Watches is not responsible for such taxes or duties and has no control over them. You should contact your customs office to determine charges in advance of purchase.

Ordering

Orders that are made in another buyer’s name without consent will be reported.

Whitehaven Watches may change prices and correct incorrect prices. Incorrect prices could result in cancelled orders in which case Whitehaven Watches will refund, this can happen at any time during ordering.

Buyers can return the order within 14 days of purchase but product and packaging must be returned as they were received. If a buyer wishes to return an order, they must contact Whitehaven Watches to get an address of return. Return shipping is paid by Whitehaven Watches unless consumer lives in an area where the postal service does not supervise returns. In which case, the consumer must cover shipping costs. If an item is damaged in transit, the customer should contact Whitehaven Watches within 14 days to determine compensation.

Warranty

The warranty is two years, from the purchase date and covers manufacturing defects including case, movement and crystal. However, other defects are not covered by the warranty. To request a warranty replacement, consumers should contact us and supply name, address, order number and information pertaining to the defect. The subject should be “Reclaim of Purchase”. Warranty return costs are covered by Whitehaven Watches however if we cannot find any defect on the watch, it will be sent back to the consumer.

Replacements and repairs will be charged in the following situations (including during warranty term):

• Aesthetic changes that occur during normal use such as minor scratches, leather changes, peeling on plating

• Damage caused by improper use (such as dents, knocks, crushing, crystal breakage etc.)

• Failure or damage caused by repair by a third party or modification

•Failure or damage caused by water, fire or natural disaster

• No date of purchase supplied

• No warranty sent with the watch

• Warranty that has been rewritten or changed

Additionally, please note, a battery change would be charged, even when a watch is under warranty and dial, hands, crystal, case or other parts (including watchband) can be replaced with substitutes if the originals are no longer stocked.

The Whitehaven warranty agrees that consumers can receive a free replacement according to the above terms (within specified date range) and this does not restrict any lawful right of the consumer.

Personal Information

When a consumer shops at Whitehaven Watches, some data is saved to fulfil order but all personal information is completely confidential. You reserve the right to request access to your data and anything incorrect can be removed or changed. The Whitehaven Watches website uses cookies which are there to improve user experience on the website. There is further information in our privacy policy.

Product

Whitehaven Watches has the right to adjust watch prices, add cost and change product information without notice. Product images and information describes the product as best possible. We cannot guarantee all pictures accurately reflect the look of the watch (colour may be different for example due to computer settings) and we reserve the right for any errors that might occur on page. All images should be viewed as illustrations and therefore do not guarantee correct characteristics and appearance.

Delivery and Cancellations

Whitehaven Watches offers worldwide shipping and deliveries are made in line with postal services plus partners. Consumers have the right to cancel purchases and return delivered goods by contacting our customer services team within 14 days from receipt of watch. The goods must be returned in the same condition as receipt. The consumer is responsible for transport risk in return to Whitehaven Watches.

If delivery is significantly delayed and you don’t wish to fulfil the order, it is your responsibility to cancel the order. If an order has been despatched it cannot be cancelled unless it has been confirmed with Whitehaven Watches. Whitehaven Watches reserves the right to cancel a purchase made on a discontinued product and refund the amount paid back to the consumer. In this instance, the consumer will be notified of replacement or similar product.

Complaints

Consumers must check their goods on receipt to make sure there is no damage and that they are correct. If there has been any damage during transport, whether noticeable or hidden, the consumer must report it ASAP to the carrier. If item has been received and it is damaged or is not the item ordered, consumer must contact Whitehaven Watches within 14 days of receipt.

Complaints must be made to Customer Service through the contact form and must include order number with reason for complaint. All products returned must be properly packaged to avoid damage during transit. Whitehaven Watches reserves the right to replace defective goods with the same model and if an item has been discontinued, the consumer will receive a refund in its entirety. If a product has been returned with no fault then it will be sent back to the consumer.

Liability

Whitehaven Watches has no direct or indirect responsibility for example but not limited to delivery delays, incompatibility, downtime, data loss, additional work or other economic harm.

Force Majeure

Whitehaven Watches is exempt from liability for damages and penalties based on the performance of circumstances beyond our control. This includes government intervention, amended legislation, new legislation, war, lack of state, flood, fire, labour disturbance, restriction, prohibition, poor transport, poor weather conditions, sabotage, lack of supplier delivery and criminal activity that affects activities.

Intellectual Property Rights

All rights such as copyright and trademarks including material published on the website are owned by Whitehaven Watches. Any use of the website, its content including copying content in part or whole other than for non-commercial use is prohibited without permission from Whitehaven Watches.

User Content

The website may include generated content from social media. Whitehaven Watches does not claim any ownership in rights in this type of content (photographs, videos, images etc.) and therefore takes no legal responsibility for it. If you suspect violation of copyright or other right or you are offended by content, please contact our customer services team.

Retention of Title

All watch products remain in Whitehaven Watches property until full payment is taken from the consumer.

Fraud

Any fraud will be reported to the authorities and Whitehaven Watches reserves the right to cancel any purchase if there are suspicions.

Governing Law and Jurisdiction

These terms and conditions and your use of www.whitehavenwatches.com are governed by are governed by England law. To the extent permitted by law England shall have jurisdiction pertaining to any dispute arising and your use of the website subject to Whitehaven Watches’ right to prosecute a user at his/her place of dwelling.

Termination

Whitehaven Watches reserves the right to terminate any account or use of the website at its discretion and without prior notice.
